1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Auto HVACPro ("Company," "we," "our," or "us") concerning your access to and use of our HVAC automation software and services (the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility

• All fees are non-refundable except as required by law

• We may change our fees with 30 days' notice

5.3 Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

• Upload viruses, malware, or harmful code
• Violate any laws or regulations

9. Service Availability

10. Disclaimers and Warranties

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTO HVACPRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Our total liability for any claims arising from or related to these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Auto HVACPro and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Services or violation of these Terms.

13. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• Request by law enforcement or government agencies

Upon termination, your right to use the Services will immediately cease. We may delete your data after termination in accordance with our data retention policies.

14. Dispute Resolution

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class actions.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
