1. Agreement to Terms
These Terms of Service constitute a legally binding agreement between you and Auto HVACPro ("Company," "we," "our," or "us") concerning your access to and use of our HVAC automation software and services.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts. If using Services on behalf of a company, you represent that you have authority to bind that entity to these Terms.
3. Account Registration
When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Immediately notify us of any unauthorized use
4. License and Access
Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your business purposes.
You may not copy, modify, reverse engineer, rent, sell, or sublicense the Services, use them for any illegal purpose, or attempt unauthorized access.
5. Subscription and Payment
Plans: Our services are offered through subscription plans as described on our pricing page. By subscribing, you agree to pay all applicable fees.
Billing: Subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method automatically. We may change fees with 30 days' notice.
Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period.
6. Data and Privacy
Your use of the Services is governed by our Privacy Policy.
You retain all rights to your business data. We do not claim ownership of any data you upload or create using the Services.
7. Intellectual Property
The Services and all content, features, and functionality are owned by Auto HVACPro and protected by copyright, trademark, patent, and other intellectual property laws. Our trademarks may not be used without prior written consent.
8. User Conduct
You agree not to upload malware, violate laws, infringe intellectual property rights, harass others, impersonate any person, or engage in fraudulent activity.
9. Service Availability
We strive to provide reliable services but do not guarantee uninterrupted, secure, or error-free access. We reserve the right to modify, suspend, or discontinue any part of the Services at any time.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTO HVACPRO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Auto HVACPro and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Services or violation of these Terms.
13. Termination
We may terminate or suspend your access immediately, without notice, for breach of these Terms, non-payment, fraudulent activity, or when required by law. Upon termination, your right to use the Services ceases immediately.
14. Dispute Resolution
Disputes shall be resolved through binding arbitration in accordance with American Arbitration Association rules. These Terms are governed by the laws of the United States.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by posting updated Terms on our website. Continued use after changes constitutes acceptance.
